English summary: Kai Wantzen examines the concept of enterprise liability, which became one of the catchphrases in American tort law after the Second World War and which was closely related to the law and economics movement. Emphasizing the extra-contractual liability of firms, the concept is based on the assumption that tort law itself should become an instrument of economic and social policies. In Germany as well, the term enterprise liability has been discussed repeatedly in relation to the problems in German law pertaining to enterprise liability in the context of the German Civil Code. The author analyzes the content of enterprise liability in relation to comparative tort law as well as law and economics. German description: Enterprise Liability ist eines der schillernden Schlagworter des US-amerikanischen Haftungsrechts nach dem Zweiten Weltkrieg. Es steht im Zentrum einer Bewegung, die sich zum Ziel gesetzt hatte, das Recht der ausservertraglichen Haftung unter Betonung einer besonderen Haftungsverantwortlichkeit von Unternehmen zu einem Instrument der Wirtschafts- und Sozialpolitik zu entwickeln. Seit es Ende der 80er Jahre zu einer Haftpflichtversicherungskrise in den Vereinigten Staaten gekommen war, ist die Politik der Enterprise Liability auf dem Ruckzug. Beides - also die Mobilisierung des Haftungsrechts fur sozialpolitische Zwecke wie auch die Zuruckdrangung des Haftungsrechts im Rahmen der jungsten tort reforms - sind in Deutschland nicht unbemerkt geblieben. Auch in Deutschland wird das Schlagwort Enterprise Liability immer wieder aufgegriffen und auf die dem deutschen Recht eigenen Probleme der Unternehmenshaftung im Kontext der 31, 831 BGB ruckbezogen. Im europaischen Kontext hat Enterprise Liability ihren Niederschlag in der Produkthaftungsrichtlinie und den jungsten Entwurfen im Rahmen der europaischen Deliktsrechtsvereinheitlichung gefunden. The relationship between the military and law has been recognised as a desideratum for quite some time, particularly with regard to the early modern period. The edited volume intends to fill this historiographical gap. It explores a hitherto neglected field in the history of early modern Europe at the crossroads between the histories of law, crime and criminal justice as well as war. The collected essays revolve around the central questions of legal norms in the context of historical change, the formation and institutionalisation of specific jurisdictions as well as the underlying transformation of early modern (military) societies.
