Eine Welt ohne Kommentare? Für den deutschen Juristen ist das kaum denkbar. Die wichtigsten Gesetzeskommentare stehen auf dem Schreibtisch jedes Juristen, und in der Praxis wird das Recht weniger dem Gesetz als dem Kommentar entnommen. Auch für die europäischen Juristen des Mittelalters und der Frühen Neuzeit bestand die juristische Welt im Wesentlichen aus Kommentaren und Referenztexten. Gleichwohl ist bislang kaum untersucht, wie der Kommentar als Medium des juristischen Diskurses im Spannungsfeld zwischen Wissenschaft und Praxis wirkt und welche Strukturmerkmale und diskursive Funktionen als typisch für einen juristischen Kommentar gelten können. Im epochenübergreifenden historischen Vergleich analysiert David Kästle-Lamparter die »Kommentarlandschaft« verschiedener Wissenschaftskulturen und zeigt die Konstanten und Variablen der Kommentarliteratur in der Geschichte des Rechts auf. Auf dieser Grundlage werden Ansätze zu einer rechtstheoretischen Phänomenologie des juristischen Kommentars sichtbar. English summary: This volume documents Hugo Preuss's understanding of law, based on constitutional and state theory, history and the social sciences, which had previously received little attention, and presents and explains his theories by dealing with the monographs, available as reprints. The influence of Otto von Gierke had caused a dispute on methods and trends in areas such as the significance of international public law, the theory of sovereignty, the position of the supreme state powers, the interpretation of the municipal level of governmental authorities and thus issues pertaining to local laws and public service. This led to the necessity for reforms in the existing administrative structures. The writings documented in this volume had a decisive influence on constitutional politics in 1918/19 and created a basis for modern constitutionalism. German description: Das politische Wirken von Hugo Preuss beruht auf einem verfassungs- und staatstheoretischen, geschichtlichen und sozialwissenschaftlichen Rechtsverstandnis, das seine gesamte berufliche Tatigkeit bestimmt hat. Dieses Konzept wird erstmals in Band 2 seiner Gesammelten Schriften dokumentiert: Keine der hier herausgegebenen Schriften ist im mehrfach nachgedruckten Sammelband Staat, Recht und Freiheit (Tubingen 1926) enthalten. Unter Einbeziehung der monographischen Werke, die als Nachdrucke verfugbar sind, wird Preuss' Lehre dargestellt und erlautert. Sie zeigt eine Uberlagerung, Konkretisierung und Fortbildung der politischen Position durch den Einfluss Otto von Gierkes, weist zugleich aber auch eine eigenstandige Weiterbildung auf. Im Gegensatz zur von Paul Laband beherrschten staatsrechtlichen Dogmatik gewinnt dadurch, lange vor der Weimarer Kontroverse, ein alterer Methoden- und Richtungsstreit Konturen. Er betrifft eine Neubewertung des internationalen Rechts, die Souveranitatslehre, die Stellung der obersten Staatsorgane, die Deutung der kommunalen, insbesondere der stadtischen Ebene der offentlichen Gewalt und damit wichtige Aspekte des Verwaltungsrechts, namentlich des Kommunalrechts und des offentlichen Dienstrechts. Daraus folgt die Reformbedurftigkeit der damals bestehenden Verwaltungsstrukturen. Insgesamt entfalten die im vorliegenden Band dokumentierten Schriften ein Programm, das fur das konkrete verfassungspolitische Wirken von 1918/19 weithin bestimmend geworden ist und damit eine Grundlage heutiger Verfassungsstaatlichkeit darstellt.

The European codification project has rapidly gathered pace since the turn of the century. This monograph considers the codification project in light of a series of broader analytical frameworks Â? comparative, historical and constitutional Â? which make modern codification phenomena intelligible. This new reading across fields renders the European codification project (currently being promoted through the Common Frame of Reference and the Optional Sales Law Code proposal) vulnerable to constitutionally-grounded criticism, traceable to normative considerations of private law authority and legitimacy. Arguing that modern codification phenomena are more complex than positivist, socio-legal and historical approaches have suggested over the past two centuries, the book stages a pathbreaking method of analysis of the law-discourse (nomos-centred) which questions at once the reduction of private law to legislation and of law to power and, on this basis, redefines the ways in which to counter law's disintegration and crisis in the context of Europeanisation. Professor Niglia reconstructs the European codification project as a complex structure of government-in-the-making that embodies a set of contingent world views, excludes alternatives, challenges the plurality of private laws and entrenches conflicts that pertain not only to form (codification, de-codification, recodification) but also to dilemmas implicated in determining the substantive orientation of European private law. The book investigates the position of the codifiers and their discontents in the shadow of the codification strategy pursued by the European Commission Â? noting a new turn in the struggle over the configuration of private law which has taken place since the Savigny-Thibaut dispute of 1814 which this book critically revisits exactly two centuries later.
