Recent constitutional thinking has directed its attention to the profound impact of 'soft' norms on the way legislation is made. This book identifies the European Union's impact assessment regime as a source of these norms. In 2002 the European Commission - later followed by the European Parliament and the Council of Ministers - committed to performing rigorous assessment of the economic, social and environmental impacts of policy options before adopting (legislative) proposals. Applying a 'constitutional lens' to this 'regulatory' topic, Anne Meuwese examines both the details and the framework of IA in EU lawmaking to date, drawing attention to its strengths, its contradictions, and its power to enhance the deliberative quality of legislative debates. Integrating the perspectives of political scientists and economists with the concerns of legal scholars and practitioners, Dr Meuwese describes and interrelates such aspects of the subject as the following: the potential role of impact assessment as a catalyst of legal principles, by emphasising or overriding norms that govern both the procedural and the substantive aspects of the EU legislative process; the 'constitutional tasks' of impact assessment as applied to European legislative proposals, especially relating to subsidiarity, proportionality, and the precautionary principle; the formal and informal extension of the scope of impact assessment beyond the co-decision procedure; the question whether impact assessment crosses the line between informing the legislator and fettering legislative discretion. This study examines in three case studies whether German plants suffer from a negative impact on competitiveness caused by stringent environmental legislation. A micro level analysis showed that abatement initiatives had in general been implemented without economic damage and did not touch on the core business. Moreover, German sample plants ranked environmental pressure as relatively unimportant compared with other competitive pressures. Finally, the low absolute levels of compliance costs, at least in two of the case studies, explained why environmental regulation cannot have a great influence on competitiveness in the chosen sectors. High productivity levels were not among the essential factors explaining our findings. It implies for our case studies that also plants with lower productivity can withstand high compliance costs.

This issue begins with an overview that distinguishes evidence-based practice (EBP) and translation science, followed by a description of Hawaii’s statewide EBP program that uses active and multifaceted translation science strategies to facilitate the rate and extent of adoption of EBP changes. With one exception, the remaining articles describe individual EBP projects from five different health care facilities that used the Iowa Model to guide their work. Each article includes an evidence summary, a description of implementation strategies, an evaluation of the innovation, and lessons learned. These completed projects were initiated between 2009 and 2012, address a variety of topical nursing issues, and, for the most part, focus on preventing complications (ie, blood sugar elevations, increased lengths of stay, extubation failures, noise-related injury, pain, surgical site infections, pneumonia, restraint use, delirium, and fever). An additional article describes the use of evidence to inform simulation-based learning, a possible strategy for ensuring competencies in and compliance with EBP interventions. Nursing leaders will come away with solid information about utilizing EBP to improve patient outcomes. The Hawaii program demonstrates that health care quality can be realized by employing the best available evidence and empowering the nursing workforce. It also offers a glimpse of the care that the future nursing workforce could provide to create a health system that provides accessible, affordable and quality care to everyone in the United States.
